Informativa sulla privacy
NB: the terms beginning with a capital letter within this privacy policy (hereinafter the “Privacy Policy”) have the same meaning as in the general terms and conditions of sale, put online on the Site and to which it is appended.
1. Categories of personal data processed:
1.1. The personal data collected in the “Buy” section of the Site are essentially your surname, your first name, your delivery address, your e-mail address, your telephone number and your bank details (credit card number).
1.2. The personal data collected in the “Join the Club” section, accessible via the “The Club Joyeuse” tab of the Site, are essentially your name, your postal code, your e-mail address, your password, the serial number of your Storyteller (hereinafter the “Storyteller”), the Storyteller's secret code, the first name(s) and birthday(s) of the child(ren) user(s) of the Storyteller as well as your billing address.
1.3. The personal data collected in the section “A question before you begin?” section, accessible via the “The Club Joyeuse” tab of the Site, are essentially your e-mail address, your request (your response to “How can we help you?”) and, optionally, your name and the subject of your message.
1.4. The personal data collected in the following sections: “Buy”, “Join the Club” and “A question before you begin?” are hereinafter collectively referred to as “Personal Data”.
2. Data Protection Officer:
2.1. The person responsible for processing Personal Data is the company JOYEUSE, a “société par actions simplifiée” (simplified joint stock company) registered in the Paris Trade and Companies Register under number 822 203 246, whose headquarters are located at 4 boulevard de la Bastille, 75012 Paris, represented by the company president, Mr. Mathieu ROUMENS - Tel: 01.47.07.17.19 - E-mail: hello@joyeuse.io.
2.2. Personal Data are collected and processed in the strictest confidentiality, in accordance with the provisions of the amended Act n°78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties (“Loi Informatique et Liberté”) and the European Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”), which came into force on May 25, 2018.
3. Legal basis for the processing of Personal Data:
3.1. The processing of Personal Data collected in the “Buy” and “Join the Club” sections of the Site is legally based on the execution of the General Terms and Conditions of Sale (“GTCS”), respectively related to the Storyteller and the Digital Contents.
3.2. The processing of Personal Data collected in the section “A question before you begin?” is legally based on JOYEUSE's legitimate interest in communicating to Users and/or Customers any information on the Storytellers, the Digital Contents and, in general, the Website and its activity.
4. Purposes of the processing of Personal Data:
4.1. Personal Data collected in the “Buy” section are used for the sole purpose of delivering the Storytellers pre-ordered on the Site and managing their payment.
4.2. Personal Data collected in the “Join the Club” section are mainly used to allow you to create a Personal Account and thus access an online recording studio, import your own audio files in order to convert them into a format readable by your Storyteller, share your opinions, ask questions, consult videos to help you use the Storyteller or download Digital Contents free of charge or against payment. In the latter case, Personal Data may also be used for the purpose of managing payment for the Digital Contents.
4.3. Personal Data collected via the “A question before you begin?” tab are collected in order to enable us to answer your questions.
4.4. Finally, if you have given your consent by ticking the corresponding box on the Site, your e-mail address may also be used to send you personalised messages regarding services linked to the Storyteller and/or Digital Contents, in which case the legal basis for processing is consent.
5. Personal Data Retention Period
5.1. Personal Data collected in the “Buy” section are kept for the entire duration of performance of the Contract, as stipulated in Article 14.1 of the GTCS.
5.2. Personal Data collected in the “Join the Club” section are kept as long as you do not deactivate your Personal Account by sending a request to this effect to the following e-mail address: hello@joyeuse.io.
5.3. Personal Data collected in the section “A question before you begin?” section are kept as long as you do not send a request for objection in accordance with the terms set out in article 7.2 of the Privacy Policy.
5.4. Personal Data used for the purpose of sending you personalised messages in accordance with article 4.4 will be kept until you withdraw your consent in accordance with the conditions set out in article 7.1 of the Privacy Policy.
5.5. At the end of the retention period, Personal Data may also be archived in accordance with the applicable legal and regulatory provisions.
6. Disclosure of Personal Data:
Personal Data are only intended for JOYEUSE’s authorised personnel and is not communicated to third parties.
7. Exercise of rights:
7.1. You have the possibility, by writing to the e-mail address: hello@joyeuse.io to:
- Exercise a right of access, in order to know the Personal Data concerning you as well as the information mentioned in article 15 of the GDPR;
- Request that the Personal Data concerning you, which would be inaccurate or incomplete, be rectified under the conditions provided for in Article 16 of the GDPR;
- Request that the Personal Data concerning you be erased under the conditions set out in Article 17 of the GDPR;
- Request the limitation of your Personal Data under the conditions provided for in Article 18 of the GDPR;
- For Personal Data collected in the “Buy” and “Join the Club” sections as well as Personal Data used to send you personalised messages in accordance with article 4.4: Right to receive your Personal Data in a structured, commonly used, machine-readable and interoperable format, and to transmit it to another data controller or obtain that these Personal Data be transmitted directly to another data controller, if this is technically possible and under the conditions provided for in article 20 of the GDPR.
- For Personal Data used for the purpose of sending you personalised messages in accordance with article 4.4: Right to withdraw your consent to receive these messages at any time, either by writing to the above-mentioned e-mail address, or by clicking on the “unsubscribe” link at the bottom of the e-mails by which we send them to you;
- File a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL).
7.2. For Personal Data collected in the section “A question before you begin?”: you also have the possibility to object, for reasons relating to your particular situation, to the processing of Personal Data concerning you, by writing to the following address: hello@joyeuse.io.
7.3. For security reasons and to avoid fraudulent requests, JOYEUSE reserves the right to ask you for proof of identity to exercise these rights, which proof will be destroyed within one (1) year of collection.
8. Transfers outside the European Union:
JOYEUSE uses applications likely to host Personal Data outside the European Union, published by companies offering appropriate guarantees in accordance with the provisions of Article 46 of the GDPR.
